Registering your trademark registration that no one is impersonating your product or service in the marketplace, removing the need to rebrand. Also, registering a trademark in India is essential if you want to protect your intellectual property and secure your rights.
Under the Trade Mark e-filing system, obtaining a Class 3 Digital Signature Certificate is mandatory. Therefore, any person, attorney or agent must obtain a Class 3 DSC before proceeding with the registration of a trademark.
Digital Signature;
Digital signature is a mathematical technique used to validate the authenticity and integrity of a digital document, message, or software. It is the digital equivalent of a handwritten signature or stamped seal, but offers more inherent security. Digital signature is intended to solve the problem of tampering and impersonation in digital communication.
Digital signatures can provide proof of origin, identity, and status of electronic documents, transactions, or digital messages. They can also be used by signatories to acknowledge informed consent. In many countries, including the US, digital signatures are considered as legally binding as traditional handwritten document signatures.
Merits of Digital Signature;
Safety Digital signatures include security capabilities to ensure that a legal document has not been altered and that signatures are legitimate. Security features include asymmetric cryptography, personal identification numbers (PINs), checksums, cyclic redundancy checks (CRCs), and CA and trust service provider (TSP) validation.
Timestamping. It provides the date and time of a digital signature, useful when time is critical, such as stock trades, lottery ticket issuance, and legal proceedings.
Globally recognized and legally compliant. Public Key Infrastructure (PKI) standards generate and store vendor-generated keys. As digital signatures have become an international standard, more and more countries are recognizing them as legal.
Time savings. Digital signatures simplify the time-consuming processes of physical document signing, storage and exchange, enabling businesses to quickly access and sign documents. Monetary gain Organizations can go paperless and save money previously spent on physical resources, time, personnel and office space used to manage and transport documents.
Positive environmental effects. Reducing paper use reduces the physical waste generated by paper and the environmental impact of transporting paper documents.
Traceability. Digital signatures create an audit trail that makes internal record keeping easier for businesses. Since everything is recorded and stored digitally, there are less opportunities for a manual soldier or record keeper to make a mistake or misplace something.
Types(classes) of digital signature;
There are three different classes of Digital Signatures
Class 1. This type of DSC cannot be used for legal business documents as it is valid based on an email ID and username only. Class 1 signatures provide a basic level of security and are used in environments with a low risk of data compromise.
Class 2. These DSCs are used for electronic filing (e-filing) of tax documents including income tax returns and goods and services tax returns. Class 2 digital signatures authenticate the signer's identity against a pre-verified database. Class 2 digital signatures are used in environments where the risks and consequences of data compromise are moderate.
Class 3. Class 3 signatures, the highest level of digital signatures, require people or organizations to present to a CA to prove their identity before signing. Class 3 digital signatures are used for e-auctions, e-tendering, e-ticketing, court filings, as well as other environments where threats to data or the consequences of a security failure are high.
