The Wikimedia Foundation, which supports the work of Wikipedia in Russia, was fined a total of 5 million rubles. Courts in Moscow found him guilty of not deleting prohibited information. We are talking about several articles that relate, among other things, to the latest events on the territory of Ukraine.
Wikipedia warned readers back in March that it was in danger of being blocked for refusing to remove an article about Russia's special operation in Ukraine. Now the warning has disappeared, the publication itself has remained. As well as other articles, which, as the court found, contain false information, including about the events in Bucha and Mariupol. For failure to remove this information, the Wikimedia Foundation was fined 3 million rubles. Another 2 million rubles of a fine will have to be paid to the fund for refusing to remove two articles on black and smokeless powder. Earlier, the courts of the Tver and Tambov regions ruled that these publications contain information about the method and methods of making explosives.
As Roskomnadzor told RBC, the Russian Wikipedia may fall under the law on "landing". The agency has already sent a request to the administration of the resource about the size of the daily audience. According to the law, which came into force on January 1, companies with a daily audience of more than 500,000 Russian users must open their representative office in our country. The Wikimedia Foundation has already stated that if such a representative office is opened, it will receive the status of a foreign agent.
Pavel Katkov, founder of KIP LegalTech, member of the Russian Chamber of Commerce and Industry Committee on Entrepreneurship in Media Communications, comments:
Pavel KatkovFounder of KIP Legal Tech, member of the Russian Bar Association“As for the statement that if Wikimedia opens a Russian representative office, it will be recognized as a foreign agent, yes, it is quite possible. He is recognized as a foreign agent if he falls under the criteria of a foreign agent, including in terms of receiving foreign funding. Here Wikimedia knows better whether it falls under these criteria or not. Here it should be noted that activity in the form of a foreign agent is difficult, of course, - in particular, by the restrained attitude towards foreign agents of advertisers, for example, various types of various partners - but nevertheless it is not prohibited. This activity is possible, but everyone will understand the status.”
Meanwhile, a witness appeared in a criminal case on the spread of fakes about the Russian army: Ilya Yashin, a deputy from the Krasnoselsky municipal district in Moscow, was interrogated as such. “I left the Investigative Committee. I was interrogated as a witness. I remain in this status for now,” he wrote on his Telegram channel.
The suspects in this case are the head of the Krasnoselsky municipal district, Elena Kotenochkina, and the deputy of the same district, Alexei Gorinov. The latter was detained for 48 hours, his lawyer said. Kotenochkina, according to Ilya Yashin, was put on the wanted list, she is outside Russia.
In early March, the Council of Deputies of the Krasnoselsky District adopted a statement of disagreement with the military operation in Ukraine. In April, State Duma deputy Alexander Khinshtein applied to the prosecutor's office with a demand to open a case against Kotenochkina after she published several posts on social networks condemning the military operation.
Article 207.3 of the Criminal Code of the Russian Federation "public dissemination of knowingly false information about the actions of the Armed Forces of the Russian Federation" came into force on April 5. Punishment - from a fine to imprisonment for a term of three to 15 years. According to this article, as previously reported by the Kommersant newspaper, several cases have already been initiated, in which there are 38 defendants.
The article needs to be finalized or at least clarified by the Supreme Court on the procedure for application. This opinion was expressed by the managing partner of the law firm "Sokolov, Trusov and Partners" Fyodor Trusov:
Fyodor TrusovManaging Partner of Sokolov, Trusov and Partners Law Office“Indeed, it is very streamlined, and you can literally pull a lot under it. In this case, an explanation of the Supreme Court is required, a decision of the plenum, which will tell how this article should be applied. Well, the truth is, I'll tell you honestly, usually when we wait for the explanation of the Supreme Court, by this moment many things have already become irrelevant. I think the special operation will be over by the time the Supreme Court decides how this article should have been applied. But I emphasize that, as a rule, very often, even from the point of view of the wording of an article of the Criminal Code, it is incorrectly applied.
In the case of spreading fakes about the actions of the Russian Armed Forces, searches were carried out in the Council of Deputies of the Krasnoselsky Municipal District, Mundep Mikhail Biryukov told RIA Novosti.
