If you stop the traffic police then know your 12 rights

SachinLLB: Hello Friends, it is very important to follow the traffic rules but many times you must have seen that the traffic police harass you by citing the traffic rules and you are treated unfairly by the police because you do not know your rights but today we  Tells you your rights so that the traffic police cannot harass you and the traffic police personnel cannot misbehave with you.

  1. In order to deduct your challan, it is very important for the traffic police to have their challan book or e-challan machine, if they do not have any of these two then your challan cannot be deducted.
  2. When your challan is deducted, then every traffic police jawan is required to be in uniform and the uniform should have the sales number and his name.  If both of these are not with the traffic police, then you can ask him to show the identity card, if the traffic police refuses to show your identity card, then you should not give the documents of your vehicle to him and file a complaint in the nearest police station.
  3. The head constable of the traffic police can fine you only 100 rupees, whereas the fine of more than this can only be done by the traffic officer ASI or SI.
  4. If your challan is deducted and you do not have money to pay the fine, then you can also deposit the fine later.  In such a situation, you will be issued a court challan and a date will be given on which you will have to go to the court and give the challan, in which case the traffic officer can keep your driving license with him.
  5. Rule 139 of the Central Motor Vehicle Act provides that if the documents are not available with the driver at that time, the driver will be given 15 days to produce the documents.
  6. Under the Central Motor Vehicle Act, if you do not immediately show the registration, vehicle certificate, insurance, pollution certificate, driving license and permit certificate to the traffic police on demand of documents, then it is not a crime.  If even after this, if the police cut the challan for not showing the documents immediately, then you have the right to get it rejected by the court.
  7. If you are stopped by the traffic police then it is your duty to stop without any argument and show them the documents asked by the police officer.  By the way, apart from driving license, vehicle registration, it is not necessary that you show any other document to them.
  8. Traffic Police cannot snatch your car key, if your car key is forcibly taken away by any policeman then you have the right to file a complaint.
  9. If your car is parked on the side of the road, the crane cannot lift it unless you are sitting inside the vehicle.
  10. If the traffic police takes you into custody for breaking the traffic rule, then it is necessary to produce before the magistrate within 24 hours of taking custody.
  11. According to section 130 of the Motor Vehicles Act, the motorist has to show the papers on demand by a traffic police officer in uniform in any public place.  But only to be shown and not to be handed over to him.
  12. It is your right that never fulfill the illegal demands of the police, if any constable is demanding money from you illegally then you can complain to the higher authorities.
